Your use of our products and systems (such as courses, software, hardware, interfaces and other components) is subject to the terms and conditions contained herein (the "Agreement"), which is a legally binding contract between you ("You," "Your" or "Yourself") and Pacific Cambria University ("Pacific Cambria University," "Pacific Cambria University.com," "We," "Us," or "Our") (or a Pacific Cambria University affiliate, if identified).
We hereby agree to provide you with access to and use of the applicable products and services you have been authorized to access and use (the "Educational services") in accordance with the terms and conditions of this Agreement. These Educational services will be provided through our online campus with an Internet-based portal, to be used by you solely to access and use the Educational Services.
The "System" shall mean the computer system (including software, hardware, interfaces and other components) operated by Pacific Cambria University and used to provide the Educational services to you. As part of our ongoing development efforts, we may, from time to time, make upgrades or enhancements to the System. You hereby acknowledge that we have made no commitments as to the exact functionality or timing of upgrades and enhancements to the System.
2. ACCESS AND USE
You may access and use the Educational Services and the System solely for educational and instructional use of the Educational Services on the System. You may access them only in accordance with the terms and conditions set forth in this Agreement. You agree that no other individuals, entities or third parties shall be allowed access to the Educational Services or the System by you. Except as expressly set forth in the foregoing, all rights with regards to the services offered herein are reserved by Pacific Cambria University and under no circumstances shall you resell, publish, transfer, distribute, sublicense, provide access to, copy, adapt, translate, reproduce, modify, enhance, or use the System, the Products or the content contained therein without our express written permission. You may not remove or alter any trademark or other proprietary notice in or on any Products. The specific content, features and functionality reflected in the Educational Services and the System are subject to change and discontinuation by Pacific Cambria University in its sole discretion.
3. COMPANY NEWSLETTER AND OTHER EMAILS
By signing up on the Website, You are opting in to receive Our Newsletters by email, other special offer emails, and/or third-party emails. If You do not wish to receive these emails, You can opt out at any time, by following the directions in the Newsletter/email.
4. ACCURATE INFORMATION
In consideration of Your use of the Website, You agree to provide true, accurate, and current information about Yourself if prompted on Our Website, and agree to promptly update such information should it change or should additional information be required by Pacific Cambria University or appropriate law. We reserve the right to request verification of, and you agree to be subject to verification of, any of the information provided by you for enrollment with and continued use of the Educational services.
Pacific Cambria University is not responsible for typos or misprints contained within Our Website. We reserve the right to correct typos, errors and descriptions as needed to maintain accurate information. Under no circumstances will Pacific Cambria University be liable for misquoted content. All information and prices should be verified prior to final transactions.
6. YOUR RELATIONSHIP WITH PARTNERS
You may not assign this Agreement to any party without our prior written consent, and any such assignment in violation of this provision shall be null and void.
You may not; (a) engage in spamming or other impermissible advertising, marketing or other activities, including, without limitation, any activities that violate anti-spamming laws or regulations; (b) transmit, display or store infringing, obscene, threatening, indecent, libelous, slanderous, defamatory or otherwise unlawful or tortious material, including material that is harmful to children or violates third party privacy rights; (c) introduce malicious programs (such as viruses, worms or Trojan horses) into the System; (d) interfere with or disrupt the integrity or performance of the System, services or the data contained or used therein; (e) attempt to gain unauthorized access to the System or its related systems or networks; or (f) harass or interfere with another user's use of the System or services. You will, at all times, comply with all applicable local, state, federal, and foreign laws in using the System and the Products. We reserve the right to suspend your access to and use of the System and the Educational Services if we reasonably believe you have undertaken, or participated in, any of the foregoing activities.
We shall retain all right, title and interest in all of our proprietary information and the Services and System, including all content, materials and data contained therein and any derivative works thereof (whether authorized or not), including any modifications made specifically for you or such course offerings in general, by Pacific Cambria University or any other third party, (including you), plus all updates and enhancements, reproductions and corrections thereof and all related patent rights, copyrights, trade secrets, trademarks, service marks, related goodwill and other intellectual property. If you submit feedback and suggestions to Pacific Cambria University regarding the Educational Services or the System, you acknowledge and agree that we may use such feedback and suggestions in any manner we see fit, and you hereby grant Pacific Cambria University a perpetual, irrevocable, and royalty-free license to all intellectual property rights you may have in such feedback and suggestions.
We shall not be obligated to maintain, revise, enhance or update the standardized Educational Services or the System, unless specifically agreed to in a separate writing from this Agreement. The specific features and functionality reflected in the Educational Services and the System are subject to change and discontinuation by Pacific Cambria University in our sole discretion. We may suspend your use of or access to the Educational Services and the System in connection with any violation of this Agreement or any other applicable terms and conditions, and you shall indemnify and hold Pacific Cambria University harmless from any liability or damages incurred by Pacific Cambria University in connection with your use of the System or your alteration or unauthorized use of the Educational Services. The Educational Services shall only be used in conjunction with the System and in accordance with these terms and conditions. You understand and acknowledge that the Educational Services may be retired or supplanted by new editions at any time, and that we are under no obligation to make new editions or replacement Educational Services available. We make no warranty or representation that the Educational Services will meet your requirements, be error-free or continue to be available for any specific time period. YOU ACKNOWLEDGE AND AGREE THAT NO WARRANTIES, WHETHER EXPRESS OR IMPLIED, ARE MADE BY Pacific Cambria University WITH RESPECT TO ANY EDUCATIONAL SERVICES OR SERVICES PROVIDED HEREUNDER, AND WE DISCLAIM ALL IMPLIED WARRANTIES AND CONDITIONS, WHETHER STATUTORY, ARISING FROM COURSE OF DEALING, USAGE OR TRADE PRACTICE, OR OTHERWISE, INCLUDING WITHOUT LIMITATION TERMS AS TO QUALITY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT. WE MAKE NO WARRANTY THAT THE SYSTEM OR THE EDUCATIONAL SERVICES OR YOUR USE THEREOF WILL BE UNINTERRUPTED OR ERROR-FREE. WE DO NOT WARRANT, GUARANTEE OR MAKE ANY REPRESENTATION REGARDING THE ACCURACY, RELIABILITY, CURRENTNESS, USE, OR RESULTS OF USE OF THE EDUCATIONAL SERVICES OR THE SYSTEM.
10. COPYRIGHT AND TRADEMARK NOTICES
The entire content of the Service and any supporting software are the proprietary property of the Company and/or its licensors, and are protected by U.S. and international copyright and other intellectual property laws. The reproduction, redistribution, modification or publication of any part of the Service without the express written consent of the Company and/or its licensors is strictly prohibited.
Unless otherwise indicated, trademarks that appear on this Service are trademarks of the Company or its affiliates. All other trademarks not owned by the Company or its affiliates that appear in the Service are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by the Company or its affiliates. You agree not to display, disparage, dilute, or taint our trademarks or use any confusing similar marks or use our trademarks in such a way that would misrepresent the ownership of such marks. Any permitted use of our trademarks by you shall be to the benefit of the Company.
11. DELIVERY POLICY
We use the shipping method to deliver all our documents. The person who will receive the shipment package shall acknowledge the shipment by signing the receipt, which shall act as a proof of delivery. It will be your responsibility if you mention a wrong deliver address; therefore, you should review the delivery address carefully so that the package is not shipped to an incorrect address.
The customer will be the sole responsible for the cost to resend a package that is returned because of an incorrect address. It is also pertinent to mention here that the delivery of the package may take up to 15 business days from the date of the verification and processing of your credit card payment.
12. Refund Policy and Procedure
When a Learner requests a program cancellation, to withdraw from PACIFIC CAMBRIA UNIVERSITY, or to drop a course, the refund policy will apply. Tuition refunds are issued when a learner prepays a portion or all of the tuition for the course session or program and a credit is due per the schedule below. How to claim your refund: To assure your refund request is approved, please make sure you meet the following requirements:

2. We will try to resolve your concern immediately or else will send you a refund request approval response email from our refund department.
3. You will be required to trash the complete Program Package including all the materials sent to you.

We may terminate this Agreement with you if: i) you violate any of the terms of this Agreement or any other agreement we may have in place with you, ii) if the Educational Services or System is provided in whole or in part by a partner of ours, and that relationship terminates, iii) if we are required to do so by law. Upon termination or expiration of the Agreement, all licenses granted hereunder shall immediately terminate, and you shall immediately cease use of and access to the Educational Services and the System. All provisions which be their nature should survive termination of this Agreement shall survive termination of this Agreement, including those pertaining to ownership of intellectual property.
15. LIMITED LIABILITY
IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES OF ANY KIND OR NATURE WHATSOEVER, SUFFERED BY YOU, INCLUDING WITHOUT LIMITATION LOST PROFITS OR GOODWILL, BUSINESS INTERRUPTIONS OR OTHER ECONOMIC LOSS ARISING OUT OF OR RELATED TO THE AGREEMENT OR ANY USE OF OR FAILURE TO BE ABLE TO USE THE SYSTEM OR THE EDUCATIONAL SERVICES. OUR MAXIMUM AGGREGATE LIABILITY UNDER THE AGREEMENT WILL IN NO EVENT EXCEED THE TOTAL FEES PAID TO Pacific Cambria University BY YOU UNDER THIS AGREEMENT. THE LIMITATIONS SET FORTH IN THIS SECTION SHALL APPLY WHETHER SUCH LIABILITY IS ASSERTED ON THE BASIS OF CONTRACT, TORT, OR OTHERWISE, EVEN IF WE HAVE BEEN WARNED OF THE POSSIBILITY OF ANY SUCH LOSS OR DAMAGE, AND EVEN IF ANY OF THE LIMITED REMEDIES IN THE AGREEMENT FAILS OF THEIR ESSENTIAL PURPOSE.
No action, regardless of form, arising under the Agreement may be brought by either party more than one year after the facts supporting the cause of action become known, or reasonably should have become known, to the claimant, except that an action for non-payment may be brought without any limitation on time.
